This auction is being conducted and managed by Dailey Realty and Auction Service, Mankato MN (hereafter the ‘Auctioneer’ or ‘Affiliate’)

on behalf of the U.S. Bankruptcy Trustee and other private consignors.

TITLED ASSETS AND GENERAL TERMS

Payment for titled assets to be made by wire transfer, certified bank check, or cash ONLY payable to Dailey Realty and Auction Service no later than Wednesday, June 11th at 5:00 p.m. Wire transfer instructions will be provided to winning bidder at the close of this auction. See "Firearms terms" for separate payment option.

BUYER’S PREMIUM of 15% with a $1,500.00 cap will be added to all purchases. 

All bidders must register with K-BID according to their terms published below for this auction in addition to complying with these Affiliate terms.

Bidder understands that inspections are critical in their determination of value when bidding and are urged to do so BEFORE advancing their bids at the end of the auction. All inspections are by appointment only by contacting Affiliate Jay Dailey at 507-625-7653 (for titled assets) or Dave Thompson 507-438-9646 (for firearms) for time and location information. During inspection vehicles can be started to observe what can be determined in a running state. Test drives are NOT available due to insurance restrictions. Photos should be considered as part of the description. PICK UP DAY IS NOT INSPECTION DAY and no refunds, discounts or credits against your final winning bid price will be offered!

All assets on this auction sell AS IS WHERE IS with no warranties, either express or implied by the Affiliate or the U.S. Bankruptcy Trustee. All titles have been verified clean and transferable. Bidders are encouraged to do their own VIN check using the VIN # provided in the lot description. 

While every effort is made to disclose known defects and flaws that may substantially impact value, bidders should take advantage of the opportunity to inspect in person. Bidder understands that, unless otherwise stated, items offered for sale are used/pre-owned and flaws and wear and tear should be expected. No mechanical inspections have been made on the vehicles unless otherwise stated in the lot description. Any statements of general condition or visible flaws are opinions based on the Affiliate's visual inspection only.

Ownership transfers upon bank verification of payment in full to Affiliate's account, and completion of all title transfer paperwork. Affiliate Dailey Realty and Auction Service will be solely responsible for the transfer of all titles of the assets offered in this auction. Title transfer and separate payment of transfer, tax, and document fees shall take place in person at the North Mankato DMV when you make your appointment for pick-up of the vehicle whether you are a dealer or private party. Please come prepared with your current driver’s license, dealer license (if applicable), and proof of insurance.

This is a privately owned and operated auction company, and it is clearly understood and agreed that auctioneer represents the seller only. Bids shall advance only as indicated by the increments published in these terms.

Purchases that are not removed by the last posted pickup time without directly contacting the Auctioneer immediately to make alternative arrangements will be deemed ‘abandoned’. No refund or credit will be given to the purchaser and disposal of these items will be at the Auctioneer’s discretion. No exceptions!

Do not bid on this auction if you cannot comply with the payment, inspection, title transfer, and pickup instructions outlined in these terms! 

FIREARMS TERMS: 

If you purchase a firearm, you will be required to pass a NICS check and must complete all required paperwork with the licensed FFL. Pistol and/or rifles with a pistol grip will require purchaser to have a valid “MN Conceal and Carry Permit” or a “MN Permit to Purchase”. Do not bid on these firearms if you cannot pass a NICS check or do not have your Permit to Purchase or Permit to Carry already in hand! If you do not pass the NICS check, you will still be required to pay for the firearm, remain in the possession of the FFL dealer, and it will be resold on a future auction for you.

A $30.00 transfer fee payable to the FFL will be charged on each firearm you purchase in addition to the total purchase, buyer’s premium, and sales tax reflected on your K-BID invoice.

You will pay the FFL either in cash or credit card at your NICS check / pickup appointment for your K-BID invoice plus any transfer/shipping fees.

When making an appointment for your NICS check and pickup of the firearm, make sure you have the following information in order:

*Your K-BID bidder profile MUST match your legal name. A Valid Driver’s license is required. 

*If paying with a credit card, the name on the credit card must match your driver’s license. 

*Your driver’s license, Permit to Purchase, or Conceal and Carry Permit MUST also match your K-BID bidder profile.

*A NICS/Transfer charge of $30.00 (taxable) will apply to each firearm you purchase with no exceptions.

*NICS checks are required regardless of whether you also have a Permit to Conceal Carry or Permit to Purchase.

OUT OF STATE PURCHASES OF FIREARMS: Federal law requires the FFL to ship all purchases of handguns or militarized rifles to a Federal Firearms Licensee located in the state of the bidder’s lawful residence. Please provide our FFL with your preferred destination FFL information to expedite the process. The bidder can only receive the firearm from the destination FFL upon completion of an ATF Form 4473 and a NICS background check. Shipping charges payable to the MN FFL will also apply in addition to your invoice amount and any transfer/NICS check fees.
