Terms & Conditions

By placing a bid, you agree to the following Terms & Conditions:

• Please review all photos and read the complete lot description carefully before bidding.
• All items are sold in their current condition as pictured and described. Most estate items are used and may show signs of age, wear, storage, prior use, repairs, missing pieces, damage, or other imperfections.
• All sales are final unless an item has been significantly misrepresented.
• Inspection is available by appointment only.
• Payment must be received by the end of the scheduled pickup window. Invoices not paid by the end of the scheduled pickup window will be processed as a No Show.
• Pickup is available only during the dates and times listed for this auction. No additional pickup days will be available.
• Buyers should not bid unless they are able to arrange pickup during the scheduled removal period.
• Items not picked up during the scheduled pickup period will be considered abandoned unless prior arrangements have been specifically approved by Kackshaws Auction before the end of pickup. No refunds will be issued for abandoned items.
• Shipping is not available. All purchases must be removed from the estate during the scheduled pickup period.
• Buyers are responsible for bringing all necessary help, tools, equipment, dollies, carts, straps, ramps, boxes, totes, trailers, trucks, padding, and other supplies required to safely remove and transport their purchases.
• Kackshaws Auction staff will not assist with lifting, carrying, dismantling, moving, loading, or transporting purchased items.
• Large or heavy items may require multiple people and specialized moving equipment. Buyers are responsible for determining what is needed before arriving for pickup.
• Buyers and anyone assisting them are responsible for their own safety during pickup and removal.
• Kackshaws Auction LLC, the auction location, property owners, and their representatives are not responsible for accidents, injuries, personal property damage, or damage to purchased items that occurs during dismantling, lifting, moving, loading, or transportation, except where liability cannot legally be excluded.
• Buyers are responsible for any damage they or their helpers cause to the property, building, doors, walls, floors, fixtures, landscaping, equipment, or surrounding items during removal.
• If a winning lot contains multiple items, all items included in that lot must be removed. Buyers may not leave unwanted portions of a purchased lot behind unless specifically authorized by Kackshaws Auction.
• Ownership and responsibility for purchased items transfer to the buyer once payment has been completed and the items have been removed from the pickup location.
• Buyers are responsible for thoroughly inspecting their purchases before leaving the pickup location and confirming that they have received the correct lot and all included items.
• Kackshaws Auction LLC is not responsible for items that are lost, damaged, misplaced, or found to be missing pieces after they have been removed from the pickup location.
• If you discover a significant issue that could not reasonably have been identified during pickup, please contact Kackshaws Auction within five (5) calendar days of pickup. Items should not be repaired, altered, discarded, or modified before contacting us.
• Please allow up to two (2) business days for us to review your request. Once a decision has been made, we will contact you with the outcome and any next steps, if applicable.
