Condition and Description of Items ByGartoUSA makes every effort to provide accurate photos and descriptions. However, all items are sold "as-is," with no warranties or representations of any kind, express or implied. Retail prices shown in titles are for reference only and may be approximate. AI TECHNOLOGY: We use artificial intelligence to help write descriptions. Errors may occur. By bidding, you acknowledge that you are bidding on the items shown in the photos, and not only on the descriptions. Bidders are encouraged to inspect items in person before bidding. In-person inspection is available on the published date: _ . Pickup day is not an inspection day. Items must be inspected before leaving the premises. No refunds will be issued for items that have been removed. Pickup and Removal Buyers who pick up items in person must schedule a pickup appointment through their K-BID control panel. All items must be picked up on the day scheduled for this auction, unless shipping was requested and approved. Items that are not picked up or shipped within the stated period will be considered forfeited and no refund will be issued. No-shows and abandoned items: Invoices that remain unpaid after the pickup period will be marked as no-shows. If the winning bidder does not confirm their purchase or coordinate pickup before the deadline, ByGartoUSA reserves the right to decide whether the item will be resold, how and to whom. Items will not be automatically offered to the next highest bidder. Items not picked up within the pickup period will be considered abandoned, regardless of payment status, and ownership returns to ByGartoUSA. Buyers are solely responsible for making sure all purchased items are present at the time of pickup. It is the bidder's responsibility to inspect items before bidding or to contact the Auctioneer with any question before placing a bid. Buyers must bring all tools, equipment and labor needed to remove items. ByGarto LLC staff does not provide assistance loading or removing items. Once items are picked up and the release form is signed, the buyer agrees that charges cannot be disputed for any reason. By placing a bid, you accept both the specific auction terms on this page and the K-BID Terms and Conditions of Use. Role of the platform: K-BID Online, Inc. ("K-BID") operates and maintains K-BID.com as a platform for independent auction companies to conduct online auctions. These companies are independent entities and are not employees, agents or representatives of K-BID. K-BID's knowledge of individual auctions is limited to the information available on the website. Bidder responsibilities: By placing a bid, you confirm that you are at least 18 years old and agree to comply with all applicable terms. Bidders are responsible for all activity under their account. Do not share your account information or passwords. All bids are binding and cannot be withdrawn. Inspection and removal: Inspection dates and times are provided for each auction. Bidders are strongly encouraged to inspect items before bidding. Pickup day is not an inspection day. Once the auction ends and the invoice is issued, the winning bidder is obligated to complete the purchase. Item condition: All items are sold "as-is, where-is," with no warranties of any kind. Buyers are responsible for doing their own research. Buyer's premium: If applicable, the buyer's premium limits apply per item, not per invoice. Auction process: Items with a reserve price will not be sold unless the reserve is met. Reserve prices may be lowered at any time at the discretion of the auctioneer. During the auction: the updated reserve status will be shown. After the auction closes: the highest bidder may be awarded the item if the reserve is lowered. At closing, items with active bidding remain open until no bids are received for three (3) minutes. Once an item enters the closing process, outbid notifications are not sent. Compliance and enforcement: Failure to comply with the auction terms, including pickup requirements, may result in suspension of bidding privileges. If bidding privileges are suspended due to unpaid invoices: Reinstatement is at K-BID's discretion. Reinstatement requires payment of a 20% penalty on unpaid invoices and a $25 reinstatement fee. A valid government-issued ID must be presented. Unpaid items will not be awarded. Duplicate accounts will be deactivated. Suspected fraudulent activity may result in removal of bids, withholding of items or permanent suspension. K-BID reserves the right to refuse service to any user and may report fraudulent behavior to the proper authorities. Seller conduct: Sellers and their agents are strictly prohibited from bidding on their own items. Sales tax: Applicable sales tax will be collected by the independent auction company conducting the auction.
